Brendan McCarthy is a skilled trial lawyer who has litigated complex cases throughout his career and has tried 20 jury trials in both state and federal court. Brendan handles a wide variety of commercial litigation matters including breach of contract, consumer fraud, products liability, and construction-related claims. He also represents clients in personal injury matters.

Experience

From 2013 through 2022, Brendan served as an Assistant U.S. Attorney in the U.S. Attorney’s Office for the District of Montana. As an AUSA, Brendan prosecuted an array of criminal matters and tried cases involving white-collar fraud, narcotics, firearms, assault and money-laundering offenses. He later served in the Civil Division of the office where his duties included serving as the civil rights coordinator. In that role, Brendan litigated complex civil cases involving employment discrimination, civil rights, tort, medical malpractice and environmental claims. Throughout his time as an AUSA, Brendan also briefed and argued appeals before the Ninth Circuit Court of Appeals.

Prior to his federal government service, Brendan was an associate in the New Jersey office of a national defense litigation firm where he handled insurance defense and commercial matters. He also worked in-house at a global insurance organization and oversaw litigation strategy for insurance-related cases throughout the country.

From 2005 through 2010, Brendan served as an Assistant Prosecutor in the Essex County Prosecutor’s Office in Newark, New Jersey where he prosecuted and tried numerous criminal cases.

Brendan began his legal career as a Law Clerk to the Hon. Frank M. Ciuffani (Ret.) in the New Jersey Superior Court, Middlesex County, Law Division.

Education

Mr. McCarthy received his B.A. from the University of Notre Dame in 2000 and his J.D. from Notre Dame Law School in 2004.

Mr. McCarthy is admitted to practice in New Jersey, New York and Montana.
